EXTENDED LOAN USER AGREEMENT, TERMS, CONDITIONS, DISCLOSURES, ACKNOWLEDGMENTS, WAIVERS, AND LEGAL NOTICES

This Extended Loan User Agreement, Terms, Conditions, Disclosures, Acknowledgments, Waivers, and Legal Notices (the "Agreement") is a legally binding and enforceable contract entered into by and between [DC FINANCING CORPORATION] (the "Company," "We," "Us," or "Our") and any individual or legal entity who accesses, applies for, receives, guarantees, repays, or otherwise interacts with any loan, financial product, service, website, mobile application, communication channel, or platform operated or provided by the Company (the "User," "Borrower," "Applicant," "Guarantor," "You," or "Your").

SECTION 1 — ACCEPTANCE OF TERMS

1. By accessing, using, applying for, signing, receiving, or continuing to use any Company service, You expressly acknowledge, confirm, and agree that You have read, understood, accepted, and agreed to be legally bound by all provisions of this Agreement.
2. You acknowledge this Agreement may be lengthy, complex, and repetitive. Such length or repetition does not reduce enforceability.
3. Choosing not to read this Agreement does not relieve You of obligations. "I didn't know" or "I didn't read" is not a defense.

SECTION 2 — DEFINITIONS

• "Loan" means any amount of money disbursed or made available to You, including renewals, extensions, or restructures.
• "Due Date" means the date repayment is required, regardless of weekends, holidays, illness, travel, or personal hardship.
• "Default" means any failure, delay, avoidance, misrepresentation, or breach, whether intentional or unintentional.
• "Platform" includes websites, apps, Telegram bots, SMS, calls, email, and any other channel used by the Company.
• "Fees" include processing, service, administrative, late fees, penalty interest, and recovery costs where permitted by law.

SECTION 3 — ELIGIBILITY & USER REPRESENTATIONS

1. You confirm You are legally capable of entering a binding contract in [COUNTRY / JURISDICTION].
2. You confirm all information You provide (identity, income, contacts, guarantor info, documents) is true, accurate, complete, and kept up-to-date.
3. Any false, misleading, incomplete, or outdated information may result in rejection, suspension, cancellation, immediate repayment demand, or lawful recovery action.

SECTION 4 — LOAN APPLICATION & APPROVAL

1. Submitting an application does not guarantee approval.
2. The Company may request additional documents (ID, selfie, signature, guarantor proof, income proof, bank/wallet details).
3. The Company may verify information through manual checks, databases, and lawful third parties.
4. The Company may approve, reject, delay, cancel, or suspend any application at its sole discretion unless prohibited by law.

SECTION 5 — LOAN AMOUNT, INTEREST, FEES, AND CHARGES

1. Loan amount, interest rate, fees, penalties, and schedule are determined by the Company and the specific loan product.
2. Interest may be calculated daily, weekly, monthly, or using other methods, including compounding, as permitted by law and disclosed to You.
3. Fees may include: processing, administrative, platform/service fees, late fees, penalty interest, and recovery/legal costs.
4. All fees are non-refundable unless mandatory law requires otherwise.

SECTION 6 — REPAYMENT OBLIGATIONS

1. You agree to repay the Loan in full, including all interest, fees, and penalties by the due dates.
2. Repayment remains required regardless of personal circumstances, missed notifications, device issues, or inability to access the Platform.
3. Failure to receive reminders does not excuse late payment.

SECTION 7 — LATE PAYMENT, DEFAULT, AND RECOVERY

1. Late payments may result in late fees, penalty interest, service restrictions, and account flags.
2. A Loan may be considered in Default if a payment is overdue, if You provide false information, avoid communication, or breach any term of this Agreement.
3. Upon Default, the Company may take lawful recovery actions, including contacting You and/or your guarantor, restricting services, and initiating legal procedures where permitted.

SECTION 8 — GUARANTOR RESPONSIBILITY

1. If You provide a guarantor, You confirm You have the guarantor's informed permission to share their details.
2. The guarantor may be jointly and severally liable, meaning the Company may seek repayment from the borrower, the guarantor, or both, as allowed by law and the guarantor agreement.

SECTION 9 — DATA COLLECTION, PRIVACY, AND CONSENT

1. You authorize the Company to collect, store, and process data necessary for verification, compliance, risk assessment, customer support, and lawful recovery.
2. Data may include: identity details, images, signatures, contact information, device/IP data, communication logs, and repayment history.
3. Data may be shared with service providers, legal authorities, regulators, or recovery partners where lawful and necessary.
4. The Company will take reasonable security measures; however, no system can guarantee absolute security.

SECTION 10 — COMMUNICATION CONSENT

1. You consent to being contacted via phone calls, SMS, email, messaging apps, and in-app notifications for verification, reminders, notices, and recovery communications where permitted by law.
2. Contact may occur at reasonable times, and may be increased during overdue or Default status.

SECTION 11 — USER CONDUCT

You agree not to:

• Provide false information or forged documents.
• Threaten, harass, or abuse staff, partners, or agents.
• Attempt to manipulate repayment records or bypass Platform controls.
• Use the service for unlawful activity.

SECTION 12 — SUSPENSION, TERMINATION, AND CONTINUING OBLIGATIONS

1. The Company may suspend, restrict, or terminate accounts for policy violations, fraud risk, compliance needs, or Default.
2. Termination does not cancel or reduce outstanding debt. All repayment obligations survive termination.

SECTION 13 — DISCLAIMER OF WARRANTIES

All services are provided "AS IS" and "AS AVAILABLE". The Company makes no warranties regarding uninterrupted service, approval outcomes, processing times, or suitability for any particular purpose, except where required by law.

SECTION 14 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of income, profit, opportunity, reputation, or data.

SECTION 15 — INDEMNIFICATION

You agree to indemnify and hold harmless the Company from claims, losses, damages, liabilities, and expenses arising from Your breach of this Agreement, misuse of the Platform, unlawful activity, or violation of third-party rights.

SECTION 16 — GOVERNING LAW & DISPUTE RESOLUTION

1. This Agreement is governed by the laws of [COUNTRY / JURISDICTION].
2. You agree to attempt good-faith resolution by contacting support at [CONTACT] before initiating formal proceedings, where permitted.

SECTION 17 — MODIFICATIONS

The Company may update this Agreement at any time. Continued use of services after updates constitutes acceptance of the revised terms, except where mandatory law requires a different process.

SECTION 18 — SEVERABILITY

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

SECTION 19 — ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between You and the Company regarding the services and supersedes prior communications, representations, or understandings, unless expressly stated in writing by authorized Company officers.

SECTION 20 — FINAL ACKNOWLEDGMENT

By clicking "I Agree", signing, or receiving loan funds, You confirm that You had the opportunity to read this Agreement, You understand it creates legal obligations, and You agree to be bound by it in full.
